4. Text Message (SMS/MMS) Communications
This section describes how Bellevue and Beyond Walking Tours LLC collects and handles information in connection with text messaging. The terms governing our text message program itself are in our SMS Terms of Service.
4.1 Consent to receive text messages
We send text messages only to mobile numbers for which we have obtained the recipient's prior express consent.
Consent by email. Our primary method of obtaining consent is by email. When we email you about a booking or an inquiry, the email states that by replying to it you consent to receive text messages from Bellevue and Beyond Walking Tours LLC. That email also tells you that you may text STOP at any time to opt out of further text messages, that you may text HELP for more information, that message and data rates may apply, and that messaging frequency may vary, and it links to this Privacy Policy and to our SMS Terms of Service.
Consent by texting us first. If you send a text message to our business number, we treat that as consent for us to reply to you by text about your inquiry or booking.
Consent to receive text messages is not a condition of purchasing any tour or service from us, and you may withdraw consent at any time as described in Section 4.5.
4.2 Types of messages we send
Our text messages are conversational and relate to a booking you have made or an inquiry you have sent us. You can expect messages such as:
- Booking confirmations and receipts
- Tour date and time reminders
- Meeting point directions and guide contact details
- Day-of updates, such as weather, route, or schedule changes
- Cancellation and rescheduling notices
- Waiver reminders
- Replies to questions you send us, and post-tour follow-up
We do not send marketing or promotional text messages.
4.3 Message frequency
Messaging frequency may vary.
4.4 Message and data rates
Message and data rates may apply. We do not charge you for text messages, but your mobile carrier may charge you for sending or receiving them according to your plan. Please contact your carrier for details.
4.5 How to stop receiving text messages
You may opt out at any time by replying STOP to any text message you receive from us. After you reply STOP, we will send a single message confirming that you have been unsubscribed, and you will not receive further text messages from us unless you opt in again. If you have an existing booking, we may still contact you about that booking by email or telephone.
To opt back in, reply START or contact us using the information in Section 15.
4.6 How to get help
For assistance, text HELP to our business number, call us at (425) 300-1049, email us at tours@bellevueandbeyond.com, or visit our website at https://www.bellevueandbeyond.com/.
4.7 Delivery and carriers
Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages.
4.8 SMS consent is not shared with third parties
SMS consent is not shared with third parties or affiliates.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as our text messaging service provider and customer service providers, is permitted. All other categories of information use and sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. Telephone Calls
We use a business telephone service to place and receive calls. If we record or monitor calls for quality or training purposes, we will tell you at the start of the call. Voicemail messages you leave for us are stored by our telephone service provider and are treated in accordance with this Privacy Policy.
6. Payment Information
Payments for tours are processed by our booking platform and its payment processors, and by our banking and payment providers for private, telephone, or invoiced bookings. When you enter payment card details, that information goes directly to the payment processor.
We do not collect or store complete payment card numbers or card security codes on our own systems. We receive only limited information such as the last four digits of the card, the card brand, the transaction amount, and whether the transaction succeeded. Our payment providers process card information in accordance with the Payment Card Industry Data Security Standard (PCI DSS) and their own privacy policies.
7. Cookies and Similar Technologies
Our website uses cookies and similar technologies. Cookies are small text files stored on your device that allow a website to recognize your browser and remember certain information.
- Essential cookies — required for the website and shopping cart to function.
- Analytics cookies — help us understand how visitors find and use our website so that we can improve it.
Most browsers allow you to refuse or delete cookies through their settings. If you disable cookies, some parts of our website may not work properly. Our website does not currently respond to browser "Do Not Track" signals.
8. How We Share Information
We do not sell your personal information, and we do not share it with third parties or affiliates for their own marketing or promotional purposes.
We share personal information only as described below:
- Service providers. Companies that perform services on our behalf and are permitted to use the information only to provide those services to us. These include our website platform, our booking and ticketing platform, our payment and banking providers, our email and business productivity provider, our telephone and text messaging provider, our accounting software provider, and our email marketing provider.
- Online travel agencies and resellers. If you book through a third-party platform, that platform shares your booking information with us and handles your information under its own privacy policy.
- Our tour guides. Guides receive the participant names, party size, contact number, and any accommodation notes needed to run your tour.
- Professional advisors and insurers. Our accountants, attorneys, and insurance carriers, where reasonably necessary, including in connection with a claim or incident.
- Legal and safety. Where required by law, subpoena, or other legal process, or where we believe disclosure is reasonably necessary to protect the safety, rights, or property of any person, to investigate fraud, or to enforce our agreements.
- Business transfer. In connection with a merger, acquisition, financing, or sale of all or part of our business, in which case the recipient will be required to honor this Privacy Policy.
- With your direction. Any other sharing you ask us or authorize us to do.
SMS consent is not shared with third parties or affiliates. As stated in Section 4.8, text messaging opt-in data and consent are excluded from every category of sharing described above and are never shared with any third party.
9. Data Retention
We keep personal information only as long as we need it for the purposes described in this Privacy Policy, and then for as long as required by law or reasonably necessary for our records. In general:
- Booking and customer records are retained for the period necessary to administer the booking, respond to disputes and chargebacks, and satisfy accounting and tax recordkeeping requirements.
- Signed liability waivers and incident records are retained for the period recommended by our insurer and legal counsel, which is generally the applicable statute of limitations plus a margin.
- Marketing contact information is retained until you unsubscribe, after which we retain a minimal suppression record so that we do not contact you again.
- Text messaging opt-in and opt-out records are retained as long as required to demonstrate compliance with applicable telecommunications rules.
10. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including access controls on our business accounts, multi-factor authentication, and reliance on established vendors for booking, payment, and email. No method of transmission over the internet and no method of electronic storage is completely secure, and we cannot guarantee absolute security.
11. Children's Privacy
Our website and booking process are intended for adults. We do not knowingly collect personal information directly from children under 13. Children are welcome on many of our tours, but bookings, waivers, and any information about a minor participant must be provided by a parent or legal guardian. If you believe a child under 13 has provided us with personal information directly, contact us and we will delete it.
12. Your Privacy Choices and Rights
12.1 Choices available to everyone
- Unsubscribe from marketing email using the link at the bottom of any marketing message.
- Stop text messages by replying STOP, as described in Section 4.5.
- Ask us to access, correct, or delete personal information we hold about you, subject to records we are required to keep.
- Decline to provide optional information, though this may limit our ability to accommodate a request.
12.2 Washington residents
Washington's My Health My Data Act gives Washington consumers rights over consumer health data. If you tell us about a mobility limitation, medical condition, allergy, or similar matter so that we can accommodate you on a tour, we use that information solely to provide the accommodation and to support your safety on the tour. We do not sell it, and we do not use it for marketing. You may ask us to confirm whether we hold such information about you, to tell you with whom we have shared it, and to delete it, by contacting us as described in Section 15.
12.3 California residents
If you are a California resident, you may have the right to know the categories and specific pieces of personal information we have collected about you, the purposes for which we use it, and the categories of third parties with whom we share it; to request deletion or correction; and to not be discriminated against for exercising these rights. We do not sell or share personal information for cross-context behavioral advertising as those terms are defined under California law.
12.4 Visitors from outside the United States
Our business is located in the United States and any information you provide is processed and stored in the United States. If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with data protection laws that differ from those of the United States, you may have additional rights, including rights of access, rectification, erasure, restriction, portability, and objection. Contact us to exercise them.
12.5 How to make a request
Email tours@bellevueandbeyond.com or write to us at the address in Section 15. We may need to verify your identity before acting on a request, and we will respond within the time required by applicable law.
13. Third-Party Websites
Our website links to third-party websites, including our booking platform, online travel agencies, review sites, and social media. We do not control those sites and are not responsible for their privacy practices. We encourage you to read the privacy policy of any site you visit.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If we make a material change to how we use your information, we will provide additional notice, such as a notice on our website or an email to customers. Your continued use of our website or services after a change takes effect means you accept the updated policy.
